ISTOČNO SARAJEVO, OCTOBER 22 /SRNA/ - An SNSD member of the House of Representatives of the Parliamentary Assembly of BiH Milorad Kojić told SRNA that the Disciplinary Commission of the High Judicial and Prosecutorial Council /HJPC/ of BiH must impose the most severe disciplinary measure on Court of BiH judge Sena Uzunović for undermining the credibility of the judiciary at the BiH level.
He emphasized that by sending a letter to the Central Election Commission /CEC/ of BiH, in which she, among other things, suggested the termination of Milorad Dodik’s function as the SNSD leader, Uzunović stepped outside the Court's jurisdiction and began interpreting a ruling that she did not even render herself, but rather the Appeals Chamber of the Court of BiH.
"Even if she had rendered that ruling herself, it must be unambiguous, and any legal consequences must also be unambiguous. No individual judge has the right to, on their own initiative and without any formal request, provide an interpretation of any court ruling," Kojić emphasized.
He reminded that Uzunović is what some have pointed out since the beginning — a passionate unitarist Bosniak, and this reveals her intentions even during the first-instance proceedings.
Kojić emphasized that her action cannot and must not go unpunished.
"It is obviously true what we have been saying - that the judiciary at the BiH level is an instrument in the hands of the Bosniaks, who are trying to use it to implement their political agendas," Kojić stated.
Pointing out that this is the clearest and best example of such behavior, Kojić said that the trust of all citizens in the judiciary is being undermined when an individual judge acts on their own initiative, provides their own interpretation in this manner, and steps outside the framework of the Constitution and the law, which is something a judge should never do.
