BREZA MUNICIPALITY THE OWNER OF LAND WITH ORTHODOX CEMETERY AND CHAPEL

SARAJEVO, FEBRUARY 6 /SRNA/ – The Visoko Municipal Court registered the land on which a Serbian Orthodox cemetery and chapel are located in the federal municipality of Breza as Breza Municipality's property, the Committee protecting Serbs’ rights in FBiH announced.

The Committee stated that on plot No. 49, designated as Založje Cemetery of 8,539 square meters, both the cemetery and the chapel are located, while on plots No. 47 and 48, covering an area of 4,374 square meters, only the cemetery is located.

They emphasized that the court registration was carried out in 2016, with the Municipality of Breza entered as the sole owner - 1/1 ownership.

"When registering the Municipality of Breza as the owner of the Orthodox chapel and cemetery, the Visoko Municipal Court acted in a case formed on December 21, 2016, which means that a newly established land registry file was created as part of the so-called harmonization process," the statement reads.

The Committee pointed out that the Court was obliged, in accordance with the Law on Land Registers, to investigate the facts ex officio, hear witnesses, determine the last actual state of possession, take statements from the parties, and gather similar information.

"Had the Court conducted a field inspection, it would have determined that this is a Serbian Orthodox chapel and cemetery and could have established the last actual state of possession," the Committee said.

The Committee also noted that within the same procedure in 2016, the Municipal Court in Visoko registered the Islamic Community as the owner of an Islamic cemetery on plots No. 348 and 349.

"Another Muslim cemetery in Breza, on plot No. 525/1, was also registered to the Islamic Community, and it is located 904 meters away from the Orthodox cemetery," the Committee added.
