BANJA LUKA, May 2 /SRNA/ – Professor of Constitutional Law Siniša Karan stated that the 33rd Report of Republika Srpska to the UN Security Council is a document that does not seek privileges, but rather respect for international law, the Constitution of BiH, and the dignity of its constituent peoples.

"For over 30 years, Republika Srpska has been sending messages of peace and calls for dialogue and cooperation, defending the letter of the Dayton Agreement. The terror continuously imposed on Republika Srpska and the constituent peoples of BiH by High Representatives, parts of the international community, unelected foreigners, the unconstitutional Court and Prosecutor's Office of BiH, the Constitutional Court of BiH, and the Court in Strasbourg has demonstrated how crucial it is to maintain the federal structure in BiH," Professor Karan told SRNA.

He explained that none of the three constituent peoples were thrilled with the solutions offered in Dayton — Bosniaks wanted a unitary BiH, Serbs wanted their own state based on the principle of self-determination, and Croats favored a federal form of association.

Thus, Dayton was the result of compromise, and a unitary BiH, Karan argued, is a political illusion that leads this troubled state union toward dissolution, because such a BiH does not and will not exist.

"Through war-mongering, anti-Dayton, and unconstitutional policies Political Sarajevo, in its desire for dominance, has for 30 years destroyed the only thing that can sustain BiH — the Dayton Agreement," said Karan.

According to him, those who dream of and forcibly push for a unitary BiH forget that such efforts do not strengthen the state, but rather accelerate their own political demise.

"It is uncivilized and devastating that, 30 years after Dayton, an attempt is still being made to impose the Office of the High Representative, an unelected foreigner, and an unconstitutional Constitutional Court of BiH as the primary holders of legislative power on a sovereign, internationally recognized state. What's worse is that political Sarajevo not only accepts this legal absurdity but applauds it," Karan emphasized.

He said that the attack by foreigner Christian Schmidt on BiH's constitutional order is the cause of the greatest political and constitutional crisis in BiH since its formation. His brazen and autocratic behavior harms BiH first and foremost, but also the Bosniaks, whose wartime goals he unsuccessfully attempts to fulfill.

"Schmidt's attempts to undermine the foundations of Republika Srpska are not just attacks on an equal entity — they are attacks on the very structure and survival of BiH as a state union. Schmidt will not destroy Republika Srpska — he will dismantle BiH. His actions are political idiocy that insult the intelligence of every citizen of this country," Karan said.

He stressed that hoping an unelected foreigner, who falsely presents himself as a High Representative outside international law, can override the will of hundreds of thousands of voters is not only a political illusion—it is an act of deep disrespect for democracy.

"The will of the people cannot and must not be subordinated to the will of an individual without a mandate, nor will Republika Srpska ever agree to have its fate dictated by someone who is neither elected, recognized, nor invited. Regardless of his German ambitions, Schmidt should not underestimate the strength and resolve of Republika Srpska and the Serb people to defend the Constitution of BiH.

We will not submit to diktats or unconstitutional realities that contradict the principles of Geneva, New York, and Dayton—the very principles upon which BiH was created by its two entities and three constituent peoples," said the professor of constitutional law.

Karan concluded that Republika Srpska remains firmly committed to peace, dialogue, and the Dayton Agreement.

"Therefore, as stated in the 33rd Report to the UN Security Council, Srpska is ready for serious negotiations with its partners in BiH. Statesmanship means defending stability, not gambling with the survival of BiH," Karan said.
