BANJA LUKA, JULY 3 /SRNA/ - It was illusory to expect any other decision from an illegal court like the Constitutional Court of BiH, other than the claim that Christian Schmidt's interventions in the Criminal Code of BiH are in accordance with the Constitution of BiH and the European Convention for the Protection of Human Rights and Fundamental Freedoms, law professor Ljubinko Mitrović told SRNA.
"Only the naive could have expected a different decision as long as those who currently sit there are making decisions in this court. A court where decisions are made by retired judges is an illegal court; everyone knows this, including themselves, and they even admit it," Mitrović said.
He stated that the legal profession has long been trampled upon and that all decisions made by such a Constitutional Court of BiH are illegitimate.
"A court that lacks two judges from Republika Srpska can under no circumstances be legitimate, regardless of the possibility that it might be legal. Therefore, as long as there are no judges from Republika Srpska in this court, its decisions are illegitimate," Mitrović pointed out.
The truncated Constitutional Court of BiH claims that Christian Schmidt's interventions in the Criminal Code of BiH are in line with the Constitution of BiH and the European Convention for the Protection of Human Rights and Fundamental Freedoms.
