SARAJEVO, JUNE 14 /SRNA/ – Milorad Kojić, SNSD deputy in the House of Representatives of the BiH Parliamentary Assembly, stated that the Constitutional Court of BiH should abandon politics and focus on the law, as the amendments to the Criminal Code of BiH imposed by Christian Schmidt are a simple legal matter that could be decided even by first-year law students.
Kojić said that the incomplete Constitutional Court of BiH does not find the issues such as the transfer of competences from Republika Srpska and unconstitutional conduct complex, whereas reviewing the constitutionality of the Criminal Code provisions imposed by Schmidt apparently is.
“The amendments to the Criminal Code imposed by Christian Schmidt are a straightforward legal issue that could be decided by first-year law students, because it is completely clear that he is not entitled to enact laws and that only the Parliamentary Assembly has that competence,” Kojić told SRNA.
He maintained that it is evident that the Constitutional Court has been and remains an extended hand of Bosniak political interests aimed at creating a unitary BiH, stigmatizing the Serb people, and abolishing Republika Srpska.
“Honourable judges, gather the strength to act within the framework of the Constitution and the law, annul the unconstitutional provision to the Criminal Code, and give the people hope that justice exists, give them hope in the rule of law. Abandon politics and focus on the law,” Kojić said.
The Constitutional Court of BiH told SRNA that the review of the constitutionality of the Criminal Code provisions imposed by Christian Schmidt is a complex matter, which is why no decision has been reached even after six months.
In December of last year, the SNSD caucus in the Republika Srpska National Assembly submitted an appeal to the Constitutional Court seeking a review of the constitutionality of certain provisions to the Criminal Code of BiH imposed by Schmidt.
Under the provisions of the Criminal Code, failure to implement decisions of the high representative led to the conviction of Republika Srpska President Milorad Dodik.
