KARAN: WHEN GUARDIANS OF BiH CONSTITUTION BECOME ITS DESTROYERS, FUTURE OF BiH IS ALSO ENDANGERED; SRPSKA HAS RIGHT TO LIVE ITS OWN LIFE!

BANJA LUKA, JULY 3 /SRNA/ - The decision of the truncated Constitutional Court of BiH to confirm the constitutionality of the imposed amendments to the Criminal Code of BiH is a final confirmation that this institution has completely abandoned its constitutional role as a guardian of the Constitution, said Republika Srpska President Siniša Karan.

The President of Republika Srpska said in a statement to SRNA that by accepting that an unelected foreigner can be a proposer, legislator, and source of law in BiH, the Constitutional Court has undermined the foundations on which every democratic and legally regulated society rests.

He stated that there can be no rule of law where a foreigner, without democratic legitimacy and without any constitutional authority, imposes criminal laws and defines criminal offences.

"But with this decision, the Constitutional Court has done something far more serious; it has confirmed that BiH was not only never sovereign, but has now officially become a protectorate," Karan said.

He added that, for that reason, Republika Srpska has the right, duty, and constitutional obligation, in accordance with international covenants on civil and political rights that form part of the Constitution, to live its own life under the Constitution of Republika Srpska of February 28, 1992, which was incorporated into the constitutional order of BiH through the Dayton Peace Agreement.

"Republika Srpska has every right to live its own life, because the Constitutional Court is undermining Geneva and New York, the foundations of the agreement of the three constituent peoples turned into a binding treaty known as the Dayton Peace Agreement," Karan said.

He stated that BiH will fall apart because of those who swear by it every day while simultaneously undermining its foundations from within, adding that when the guardians of the Constitution become its destroyers, not only constitutionality is endangered, but also the very future of BiH.

The truncated Constitutional Court of BiH stated that Christian Schmidt’s interventions in the Criminal Code of BiH are in accordance with the Constitution of BiH and the European Convention for the Protection of Human Rights and Fundamental Freedoms.
