SARAJEVO, JULY 3 /SRNA/ - Milan Petković, a member of the Serb Caucus in the House of Representatives of the Parliamentary Assembly of BiH, said that judges of the truncated Constitutional Court of BiH did not respect the positions of the legislative authorities in BiH when they ruled that Christian Schmidt’s interventions in the Criminal Code of BiH are in accordance with the Constitution of BiH and the European Convention for the Protection of Human Rights and Fundamental Freedoms.
"The decision is surprising given the clear position of the Constitutional and Legal Affairs Committee of the House of Representatives of the Parliamentary Assembly of BiH that the only legislator in BiH is the Parliamentary Assembly, and that no high representative can change the Constitution through decisions or enact laws, as this is not in accordance with the Constitution of BiH," Petković told SRNA.
He said it is not clear to him what legal logic and reasoning the judges of the truncated Constitutional Court of BiH used when adopting such a decision on the appeal filed by SNSD members of the National Assembly of Republika Srpska.
"It is obvious that they had a completely different opinion from the legislative body and that they absolutely do not respect the positions of the legislative authority, which is bad for BiH, for the principles of democracy and the rule of law," Petković concluded.
The truncated Constitutional Court of BiH stated that Christian Schmidt’s interventions in the Criminal Code of BiH are in accordance with the Constitution of BiH and the European Convention for the Protection of Human Rights and Fundamental Freedoms.
