BELGRADE, JULY 3 /SRNA/ - Deputy Chairman of the Council of Ministers Staša Košarac said today in Belgrade that by ruling that Christian Schmidt’s imposed decisions on amendments to the Criminal Code are constitutional, the truncated Constitutional Court of BiH has once again confirmed that it has become a political body used against the institutions of Republika Srpska.

Commenting on the decision of the truncated Constitutional Court of BiH, which claims that Schmidt’s imposed amendments are not only in line with the Constitution of BiH but also with the European Convention for the Protection of Human Rights, Košarac said that the Constitutional Court has shown it serves the interests of those who do not wish to realistically assess the situation and who do not want to implement the Constitution.

"Instead of defending the Constitution from BiH itself, the Constitutional Court has become a political body used against the institutions of Republika Srpska. It is especially illogical that the court seeks to legitimize a foreigner who came to BiH ‘illegally’, as he was never legally appointed," Košarac told SRNA.

He said the fact that Schmidt, who has caused serious political damage in BiH, and especially in Republika Srpska, has left the country confirms the correctness of the policy of Republika Srpska President Milorad Dodik.

"Schmidt left because they realized they had made a serious mistake in BiH. But today, the Constitutional Court of BiH seeks to legitimize and verify his decisions, which speaks to the absurdity of BiH’s institutions," Košarac said.

He believes this reflects the poor state of institutions, arguing that they have not only been instrumentalized but have also taken on the role of acting against the institutions of Republika Srpska, as some previous high representatives did, by imposing decisions and using the Bonn powers.

"It is completely clear that BiH is in a contaminated state due to the role of foreigners - the EU and the Constitutional Court of BiH - and their desire to turn BiH into a unitary state, and in that context to nationally delegitimize Republika Srpska and the Serb people. These are all the policies we are facing," Košarac said.

He added that thanks to the serious statesmanship and nationally responsible policy of President Dodik, Republika Srpska is managing to withstand such attacks.

"We in Republika Srpska define our policy in accordance with the Constitution, we affirm the still nearly failed Dayton Peace Agreement in an effort, together with reasonable actors in the FBiH - still assuming they exist - to gather based on the constitutional order and return to the original Dayton framework, and to ensure that all decisions in BiH are the product of domestic politicians without any foreigners present in the BiH," Košarac said.
