BANJA LUKA, MARCH 29 /SRNA/ - Professor of constitutional law Siniša Karan has told SRNA that today, on the anniversary of the decision of the Truncated Constitutional Court of BiH from 2019 declaring the provision of the Law on Republika Srpska Day unconstitutional, it is necessary to remind all actors in BiH that the will of the people expressed in the elections is the sole and real sovereign.

Karan said that with this instructed decision, with which they tried to take away the right of Srpska and the Serb people to freely decide on issues of crucial importance for their identity, survival and development, the historical facts that Republika Srpska was established in peace on January 9, 1992, and that its people in 2016 in a referendum unequivocally confirmed that they want to celebrate January 9 as Republic Day, cannot be erased.

"The will of the people is above all and no institution, not even the Constitutional Court of BiH, especially not the truncated one, has the right to interfere with it. Interference with the democratically expressed will of the people, especially by the Constitutional Court, which has been visibly acting under the influence of certain interest groups for a long time, is a serious and inadmissible attack on the foundations of democracy," Karan emphasized for SRNA on the occasion of the anniversary of the decision of the truncated Constitutional Court declaring the provision of the Law on Republic Day unconstitutional.

Professor Karan indicated that today it is especially clear that the Constitutional Court of BiH, which should be the guarantor of constitutionality and balance, and not an instrument for unitarization and majorization of the rights of entity and constituent peoples, makes its decisions exclusively against Serbs and Srpska, regardless of the subject of the appeal.

He stated that it is shameful and humiliating and emphasized that the Constitutional Court of BiH is only one of the tools for realizing the interests of Sarajevo's political elites and part of the international community who cannot bear the fact that Republika Srpska is older than Dayton BiH.

"And you, gentlemen, who won't face the truth, who won't admit and accept the irrefutable facts, Republika Srpska existed and was an independent state from 1992 to 1995, no matter how hard it was for you. Srpska agreed to the Dayton Agreement and brought its sovereignty into the Dayton BiH, not the other way around. That's what hurts you, but you can't go against the arguments!" Karan said.

He pointed out that the truncated Constitutional Court of BiH and other destroyers of Dayton BiH persistently ignore this fact and by all means try to reduce the fundamental political autonomy and sovereignty of Republika Srpska with their decisions.

"The leadership of the Republic, of course, recognized these monstrous policies of the truncated Constitutional Court of BiH and its fellows, and resolutely and continuously rejects them institutionally! Republika Srpska, as the constitutional defender of Dayton BiH, decisively goes one step further, adopting its new constitution.

The new constitution, which is in the stage of public discussion, represents a key step by which we defend our autonomy and future, and return the sovereignty and strength of Republika Srpska to the Dayton principles," Professor Karan explained.

By adopting the new constitution, the professor of constitutional law said, we will fiercely respond to numerous attempts by foreign factors, high representatives and unconstitutional institutions to threaten the will of the people, the integrity of Srpska and Dayton BiH.

"The new constitution will put things in their place and return everything to the constitutional framework, where domestic legally and legitimately elected representatives will make decisions and decide, and not let foreigners and political mathematics who trample on the electoral will of citizens make decisions for us," Professor Karan concluded.
