INCOMPLETE BiH CONSTITUTIONAL COURT’S DECISION ON DRAFT SRPSKA CONSTITUTION POLITICAL

SARAJEVO, MARCH 27 /SRNA/ – The decision of the incomplete Constitutional Court of BiH that the Draft Republika Srpska Constitution is not in accordance with the Constitution of BiH is purely political, without any sense or significance, Vitomir Popović, the chair of the Working Group for drafting new Republika Srpska Constitution, told SRNA.

"That is not the only decision of a distorted nature made by the Constitutional Court of BiH. They abandoned long ago what represents constitutional dispute resolution and started dealing exclusively with politics," Popović emphasized.

According to him, in no country in the world has it ever been possible to determine the constitutionality of a draft document.

"One determine a draft, conduct a debate, and then change it in that direction ten times, if not more, before adoption," Popović said, stressing that the decision of the incomplete Constitutional Court of BiH regarding a draft as a legal act that cannot produce legal consequences is without any sense or significance.

As a lawyer and someone who previously served as a judge of the Constitutional Court of BiH, Popović expressed regret that the court has turned into an ultimate political body of the worst kind.

He stressed that even first-year law students would know that the Constitutional Court cannot determine whether a draft is in accordance with the Constitution.

The incomplete Constitutional Court of BiH determined that the Decision on establishing the Draft Constitution of Republika Srpska is not in accordance with the Constitution of BiH and ordered the Republika Srpska National Assembly, all competent authorities in Srpska, as well as all officials or responsible persons in those institutions, to suspend all activities undertaken on its basis.
