BANJA LUKA, SEPTEMBER 2 /SRNA/ – The Prime Minister-designate for the formation of the new Government of Republika Srpska Savo Minić stated that "we must be aware of the fact that for 30 years the Dayton Agreement has been systematically destroyed through the decisions of high representatives, interventions by part of the international community, and through rulings of the BiH Constitutional Court".

"We can rightfully say that in this way a coup d'etat has been carried out against Republika Srpska, with the aim of abolishing Republika Srpska as an equal entity and the Serb people as a constituent people in the state union of BiH," emphasized Prime Minister-designate Minić while presenting the program of the new Government at a special session of the National Assembly of Republika Srpska.

He pointed out that the coup d'etat against Republika Srpska was deliberately designed and prepared for years, finalized by the decision of the unconstitutional BiH Court, which passed a final conviction against the President of Republika Srpska Milorad Dodik.

According to him, this ruling was adopted with the intention of becoming a precedent and a fundamental practice for all future proceedings, in such a way that acts of lower legal force coming from Sarajevo derogate all acts adopted by the highest institutions of Republika Srpska.

"In this way, the rule of law and the hierarchy of legal acts are being derogated, along with the already well-known unlawful and anti-Dayton usurpation of legislative, judicial, and executive powers by all previous high representatives and the unelected Christian Schmidt.

The CEC decision to revoke the mandate of the President of Republika Srpska is unconstitutional. I repeat today that there are two constitutional grounds for the premature termination of the president's mandate – recall and resignation. A court ruling cannot be a reason for termination of the mandate, since it is not specified in the Constitution.

Therefore, we will respond to such a decision of the CEC and their decision to call elections with a referendum, at which our people will decide whether they are for foreign interventions and impositions or for the defense of institutions and Republika Srpska itself!" Minić declared.

He stated that BiH has become impossible and unsustainable because of others, not because of us!

Minić said that the aim of the court proceedings against the legal and legitimate President of Republika Srpska is to pave the way for the confiscation of the property of Republika Srpska and its transfer to BiH.

"The President /of Republika Srpska Milorad/ Dodik has consistently and uncompromisingly defended the constitutional competences of Republika Srpska according to which the Republic has its property and freely disposes of it, as well as all other functions guaranteed by the Constitution.

The BiH Court attempted to illegally and illegitimately introduce into the constitutional system of BiH both the actions of Christian Schmidt and the institution of the high representative, which has a colonial character, by stating in its ruling that the high representative `constitutes a notorious part of the state and legal system of BiH, that is, of its constitutional order,`" Minić stated.

In this way, he pointed out, an attempt is being made to establish court practice in BiH's regular courts which is disastrous for the Serb people.

"In this way, an attempt is being made to spread fear directed at all politicians in Republika Srpska, with the ultimate aim that we all be disciplined according to their dictates," Minić stressed.

He added that the high representative of the international community in BiH is a Dayton category, but not a constitutional one, since he is not mentioned in the BiH Constitution, but in Annex 10, and therefore the high representative has no constitutional powers.

"Honorable members of parliament, we must be vigilant and pay daily attention to the aforementioned and similar so-called legal constructs which are everything but legal and constitutionally grounded constructs," Minić said.

He reminded that Republika Srpska and the Serb people have the right to self-determination in accordance with numerous international documents, among which the Covenant on Civil, Social, Political and Other Rights already in its first article establishes the right of peoples to self-determination, as well as the UN Charter.

These and many other universally accepted international law acts, he added, represent an integral part of the constitutional system in BiH and therefore Republika Srpska has every right to invoke them.

"Self-determination will be the response of Republika Srpska if the other parties to the Dayton Agreement do not accept full respect and implementation of what was signed in Dayton," Minić said, reminding that the bearers of sovereignty in BiH are the constituent peoples and entities.

The Dayton constitutional arrangement, with all its shortcomings, as he emphasized, represents the only possible constitutional-legal framework for the survival and functioning of BiH on the constitutionally proclaimed principles of parity and consensus.

"BiH is in a state of usurpation of power, derogation of the Dayton Peace Accords, and abolishment of the rule of law, about which they lecture us a lot, but regularly annul it with brazen decrees and unilateral impositions," Minić emphasized.

According to him, the National Assembly of Republika Srpska, as the bearer of the sovereign will of the people of Republika Srpska, has the right and obligation to protect the constitutional order of Republika Srpska and the constitutional order of BiH.

"Honorable members of parliament, you are the bearers of the people's will and you have the power to preserve both Republika Srpska and its constitutional competences," Minić concluded. /to be continued/
